{"id":14021,"date":"2026-08-17T17:04:43","date_gmt":"2026-08-17T17:04:43","guid":{"rendered":"https:\/\/cuencasagradas.org\/?p=14021"},"modified":"2026-08-21T17:02:10","modified_gmt":"2026-08-21T17:02:10","slug":"veredicto-oral-tatiana-roa","status":"publish","type":"post","link":"https:\/\/cuencasagradas.org\/en\/veredicto-oral-tatiana-roa\/","title":{"rendered":"Oral (Preliminary) Verdict by Judge Tatiana Roa at the Tribunal for the Rights of Nature, August 19, 2026, Puyo, Ecuador"},"content":{"rendered":"<p class=\"wp-block-paragraph\">Transcript of Judge Tatiana Roa\u2019s Verdict:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\"This Tribunal considers that it is necessary to reiterate and deepen our position on Block 64 and, therefore, issues the following judgment:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>First, it reiterates the recognition of the rights of Mother Earth and the rights of Indigenous peoples over their ancestral territories.<\/li>\n\n\n\n<li>Second, it calls for the suspension of proceedings related to Block 64, in accordance with applicable national and international obligations.<\/li>\n\n\n\n<li>Third, it urges the Peruvian State to review and annul the decisions that authorize and facilitate the exploitation of the block, particularly Supreme Decree No. 024-2025-DM.<\/li>\n\n\n\n<li>Fourth, it demands that any decision concerning the territory fully respect the rights to prior, free and informed consultation and consent of the affected Indigenous peoples.<\/li>\n\n\n\n<li>Fifth, it calls for the restoration of the ecosystems and territories that have been affected as a result of previous oil activities carried out in their territories.<\/li>\n\n\n\n<li>Sixth, it recognizes the importance of Indigenous peoples\u2019 own forms of self-government and self-protection in defending their territories, and calls on the State to guarantee the conditions necessary for those who exercise this defense to do so without threats, persecution, or criminalization.<\/li>\n\n\n\n<li>Seventh, it agrees to make this decision available to the Inter-American Commission on Human Rights and other relevant international bodies, as a contribution by this Tribunal to the defense of the rights of Indigenous peoples and nature, and calls for mechanisms to be established to monitor compliance with these recommendations.\n\nWe know that this is the decision of an ethical tribunal and that it does not have the coercive force of a judgment issued by a State court. But that does not mean that it lacks power. It can have the power to name what is happening, to preserve memory, to recognize voices that have been silenced, and to open pathways toward another form of justice.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>That is why I would like our decision not to be simply a condemnation of what has happened. I would also like it to be a message to the Achuar, Wampis, and Chapra peoples: your resistance matters\u00a0<\/strong> your knowledge matters; your defense of your territory is legitimate and represents a possible future. Because perhaps justice does not consist solely in repairing harm after it has occurred. It also consists of ensuring that a people can continue to be a people, that a territory can remain a territory of life, and that the beings who inhabit it can continue to exist. Perhaps this is one of the paths that this Tribunal can help open. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Thank you very
